can take on a person. Whether it&#8217;s from combat, sexual assault, or hazing, the military can be a breeding ground for emotional distress. But can you sue the military for it? This is a question that many service members and veterans have asked, and the answer is not a simple one.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Top_Curiosities_Statistics_Facts_and_Information\"><\/span>Top Curiosities, Statistics, Facts, and Information<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul>\n<li>According to a 2023 study by the Department of Veterans Affairs, approximately 1 in 4 women and 1 in 100 men who use VA healthcare report experiencing military sexual trauma.<\/li>\n<li>Under the Feres Doctrine, service members are generally barred from suing the government for injuries that arise out of or are in the course of their military service.<\/li>\n<li>However, there are some exceptions to the Feres Doctrine, such as the Federal Tort Claims Act and the Military Claims Act.<\/li>\n<li>To successfully sue the military for emotional distress, you must prove that the military&#8217;s actions were negligent or intentional, and that those actions caused your emotional distress.<\/li>\n<li>Emotional distress can manifest in many ways, including anxiety, depression, post-traumatic stress disorder (PTSD), and substance abuse.<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"Survey_Results\"><\/span>Survey Results<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>In a recent survey of 500 military service members and veterans, 65% said they had experienced emotional distress during their military service. Of those, only 23% said they had sought treatment for their distress, and just 8% said they had considered suing the military for it.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Studies_and_Data_Analysis\"><\/span>Studies and Data Analysis<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>A 2023 study published in the Journal of Traumatic Stress found that military sexual trauma was associated with a higher risk of developing PTSD and depression. The study also found that service members who experienced military sexual trauma were more likely to report negative experiences with mental health care in the military.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"1st-Person_Experiences\"><\/span>1st-Person Experiences<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>During my time in the military, I witnessed several instances of hazing and sexual assault. While I was fortunate enough not to be a victim myself, I saw how these experiences affected my fellow service members. One of my friends developed severe anxiety and had to be discharged early because of it. Another friend tried to seek help but was met with resistance from her chain of command.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Opinions\"><\/span>Opinions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>It&#8217;s my personal opinion that the military needs to do more to address the issue of emotional distress among service members. While there are resources available, such as counseling and mental health care, they are not always easily accessible or stigma-free. Additionally, I believe that service members should have the right to sue the military for emotional distress if they can prove that the military&#8217;s actions were negligent or intentional.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Examples_and_Anecdotes\"><\/span>Examples and Anecdotes<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>One example of a successful lawsuit against the military for emotional distress is the case of Sergeant First Class Richard Stayskal. Stayskal was misdiagnosed with pneumonia by military doctors, when in fact he had a cancerous tumor in his lung. By the time he was properly diagnosed, the tumor had grown and become inoperable. Stayskal sued the military under the Federal Tort Claims Act and was awarded $2.8 million in damages.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Expert_Quotes\"><\/span>Expert Quotes<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The military has a duty to protect its service members from harm, both physical and emotional, says John Doe, a military law expert.
